Terms of Service

These terms form the agreement between you and fluenci.ai Inc. for use of the Fluenci.ai AI Flight Simulator, verified profiles and related services.

1. Who we are

Fluenci.ai is operated by fluenci.ai Inc. (“Fluenci”, “we”, “us”), a company based in Ontario, Canada. By creating an account or running a simulator scenario you accept these Terms of Service, our Privacy Policy and our Cookie Policy.

2. Your account and authentication

  • Accounts are created through OAuth sign-in (Google, Apple) or email and password. You are responsible for keeping access to that identity provider secure.
  • You must be at least 16 years old and provide accurate name and email information.
  • One account per person. Shared, resold or automated accounts may be suspended.
  • You may close your account at any time by writing to admin@fluenci.ai.

3. Certification fees are non-refundable once a scenario runs

Certification access is sold as a one-time fee (including discounted squad and gift passes). Because each scenario consumes live AI evaluation capacity, the fee becomes non-refundable as soon as you run any scenario against the evaluation engine. If you have purchased access but have not yet run a scenario, contact admin@fluenci.ai and we will refund the purchase.

Prices are shown in the currency displayed at checkout and exclude taxes where applicable. Payments are processed by Stripe; we do not store card details.

4. Verified profile licence

When you publish a verified profile you grant fluenci.ai Inc. a worldwide, non-exclusive, royalty-free licence to host, display and share that profile — your name, avatar, scenario scores, badges and telemetry summaries — at a public verification URL so recruiters and third parties can check it.

  • You may set your profile to private at any time, which removes it from public view going forward.
  • You confirm the work submitted in each scenario is your own and was not produced by another person on your behalf.
  • We may revoke a credential we reasonably believe was obtained through cheating, sharing or misrepresentation.

5. Acceptable use

You agree not to:

  • Use bots, scripts, scrapers or any automated means to run scenarios, harvest profiles or submit results.
  • Attempt prompt injection, jailbreaks or other manipulation of the evaluation engine, graders or system prompts to influence scoring.
  • Reverse engineer, resell or republish scenario content, datasets, rubrics or assertions.
  • Interfere with the service, probe our infrastructure, or bypass rate limits, paywalls or access gates.
  • Upload unlawful, infringing or personal data belonging to others into simulator inputs.

Note that adversarial security scenarios inside the simulator are an intended part of the curriculum; the prohibition above applies to attacks against Fluenci itself.

6. AI outputs and no professional advice

The simulator uses large language models. Outputs may be inaccurate or incomplete and scores reflect performance against our rubrics only. Nothing on Fluenci.ai is legal, financial, medical or employment advice, and a credential is not a guarantee of employment.

7. Intellectual property

We own the platform, scenarios, rubrics and branding. You own the prompts and text you write, and grant us a licence to process, evaluate and store them to operate the service and display your verified results.

8. Availability, changes and termination

The service is provided on an “as is” and “as available” basis. We may modify, suspend or discontinue features, and may suspend or terminate accounts that breach these terms. We will post material changes to these terms on this page and update the “last updated” date.

9. Limitation of liability

To the maximum extent permitted by law, fluenci.ai Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities or lost data. Our total aggregate liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $100.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts located in Toronto, Ontario have exclusive jurisdiction over any dispute, subject to any consumer protection rights you have in your place of residence.
